Please read these Terms of Service carefully before using the RideBetter platform as a driver. By using the platform, you agree to be bound by these terms. If you do not agree, you may not use the platform.
RideBetter is a ride scheduling platform owned and operated by RideBetter LLC, a Kansas limited liability company ("Company," "we," "us," or "our"). The platform provides technology tools that allow independent drivers to manage ride scheduling with riders they have personally invited. RideBetter is not a transportation company and does not provide transportation services. We do not dispatch drivers, set fares, or control the terms of any transportation arrangement.
You are an independent contractor, not an employee, agent, or partner of RideBetter LLC. Nothing in these Terms creates an employment relationship, partnership, joint venture, or agency relationship between you and RideBetter LLC. As an independent contractor, you are solely responsible for:
RideBetter LLC will not withhold taxes, provide benefits, or exercise control over how you perform your driving services.
You are solely responsible for maintaining appropriate insurance coverage for your vehicle and your driving activities. You acknowledge and understand that:
By using the platform, you represent that you have investigated your insurance situation and accept full responsibility for any gaps in coverage.
RideBetter is an invite-only platform. You control which riders can request rides from you. Only riders you have personally invited through the platform may book rides with you. RideBetter LLC does not match you with unknown riders and is not responsible for any rider you choose to invite.
By using RideBetter, you agree that you will:
RideBetter does not process, facilitate, or handle payments between riders and drivers. Any compensation for rides is a private matter between you and your riders and takes place entirely outside the platform. You are responsible for all tax obligations related to income you earn through your driving activities. RideBetter LLC has no responsibility for payment disputes or any financial arrangements between you and your riders.
Access to RideBetter is currently free during the beta period. We intend to introduce a flat monthly subscription fee for drivers following the beta period. We will notify you of any upcoming fee changes in advance and will not charge you without your agreement. RideBetter will never take a percentage of the fares you charge your riders.
By using the RideBetter platform, you consent to receive SMS text messages from RideBetter LLC related to platform activity, including ride request notifications and account alerts. Message frequency will vary based on ride activity. Standard message and data rates may apply. You may opt out of SMS notifications at any time by replying STOP to any message we send, or by contacting us directly.
To the maximum extent permitted by applicable law, RideBetter LLC, its members, managers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform or any transportation you provide, including but not limited to personal injury, property damage, or loss of any kind. In no event shall RideBetter LLC's total liability to you for any claim arising out of or related to these Terms or your use of the platform exceed one hundred dollars ($100.00).
You agree to indemnify, defend, and hold harmless RideBetter LLC and its members, managers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) any transportation you provide to a rider; (c) your violation of these Terms; (d) your violation of any law or the rights of any third party; or (e) any incident occurring in your vehicle during or in connection with a ride arranged through the platform.
The RideBetter platform is provided "as is" and "as available" without warranties of any kind, express or implied. RideBetter LLC does not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We may update these Terms from time to time. If we make material changes, we will notify you through the app and provide an opportunity to review the updated Terms before continuing to use the platform.
These Terms are governed by the laws of the State of Kansas, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of the platform shall be resolved in the state or federal courts located in Johnson County, Kansas, and you consent to personal jurisdiction in those courts.
These Terms constitute the entire agreement between you and RideBetter LLC regarding your use of the platform as a driver and supersede any prior agreements or understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
