Rider Terms and Conditions

1. About RideBetter

RideBetter is a ride scheduling platform owned and operated by RideBetter LLC, a Kansas limited liability company ("Company," "we," "us," or "our"). The platform connects riders with independent drivers who have personally invited them to use the service. RideBetter is not a transportation company and does not provide transportation services. We provide technology that facilitates scheduling and communication between riders and their designated driver.

2. Your Relationship with Your Driver

The driver who invited you to RideBetter is an independent individual, not an employee, agent, or contractor of RideBetter LLC. Any transportation arrangement you make through the platform is a private arrangement directly between you and your driver. RideBetter LLC is not a party to that arrangement and has no control over, and accepts no responsibility for:

• Whether your driver accepts or fulfills any particular ride request
• The manner in which transportation is provided
• The safety, condition, or maintenance of any vehicle
• The conduct of your driver before, during, or after a ride
• Any agreement about payment, timing, or other terms between you and your driver

3. Payment

RideBetter does not process, facilitate, or handle payments between riders and drivers. Any compensation for rides is a private matter between you and your driver and takes place entirely outside the platform. RideBetter LLC has no responsibility for payment disputes, refunds, or any financial arrangements between you and your driver.

4. Insurance

RideBetter LLC does not provide, arrange, or verify automobile insurance coverage for any driver on the platform. Your driver is solely responsible for maintaining whatever insurance coverage they deem appropriate for their vehicle and activities. You acknowledge and understand that:

• Standard personal automobile insurance policies may not cover incidents that occur during ride-for-hire arrangements
• RideBetter LLC makes no representation or warranty about the insurance status of any driver
• You assume the risk of riding in a vehicle where the scope and adequacy of insurance coverage is unknown to RideBetter LLC

You are encouraged to ask your driver directly about their insurance coverage before accepting a ride.

5. No Guarantee of Availability

RideBetter does not guarantee that your driver will be available for any particular ride request, at any particular time, or at all. Drivers set their own availability and may decline or cancel rides at their discretion. RideBetter LLC has no liability for any inconvenience, loss, or expense arising from a driver's unavailability or cancellation.

6. Your Responsibilities

By using RideBetter, you agree that you will:

• Provide accurate information when creating your profile and requesting rides
• Treat your driver respectfully and with courtesy
• Comply with any reasonable requests your driver makes regarding conduct in their vehicle
• Not use the platform for any unlawful purpose
• Not share your account or invite link with others

7. Limitation of Liability

To the maximum extent permitted by applicable law, RideBetter LLC, its members, managers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform or any transportation arranged through it, including but not limited to personal injury, property damage, or loss of any kind. In no event shall RideBetter LLC's total liability to you for any claim arising out of or related to these Terms or your use of the platform exceed one hundred dollars ($100.00).

8. Indemnification

You agree to indemnify, defend, and hold harmless RideBetter LLC and its members, managers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) any transportation arrangement you make with a driver; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

9. Disclaimer of Warranties

The RideBetter platform is provided "as is" and "as available" without warranties of any kind, express or implied. RideBetter LLC does not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Privacy and SMS Consent

By using RideBetter, you consent to the collection and use of your name and phone number for the purpose of facilitating ride scheduling with your driver and sending you SMS notifications about your rides. You may opt out of SMS notifications at any time by replying STOP to any message we send. We do not sell your personal information to third parties. For full details, see our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app and ask you to re-acknowledge the updated Terms before continuing to use the platform.

12. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of the platform shall be resolved in the state or federal courts located in Johnson County, Kansas, and you consent to personal jurisdiction in those courts.

13. Entire Agreement

These Terms constitute the entire agreement between you and RideBetter LLC regarding your use of the platform as a rider and supersede any prior agreements or understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
